A man from California has been charged with the crime of selling unlicensed Viagra, the U. S. Food and Drug Administration said Wednesday.
Michael Maloney, 34, of Los Angeles, was arrested last month after he allegedly sold more than 100,000 Viagra tablets over the Internet. Maloney faces one to three years in federal prison and five years for trafficking in unlicensed sex drugs. He's been sentenced to 10 to 20 years in prison and ordered to pay $1.4 million in restitution.
Maloney, from California, was a defendant in a long-running scheme to traffic in unlicensed Viagra and other erectile dysfunction drugs that are not FDA-approved for sale.
When the drugs were found to be counterfeit, a federal investigation found the illegal drug sales took place, the agency said.
"We're going to continue to work with the FDA to determine the extent of these crimes," said U. Attorney for the Southern District of California Michael Schumacher. "We've seen a very bad side effect from the criminal enterprise in the past, but it has not gone unchecked."
Federal prosecutors said Maloney and his co-conspirator, John L. Lechleiter, had several agreements with the undercover drug investigators that they would take from Maloney in order to establish their role in the illegal scheme.
The illegal activity took place in Los Angeles, California, and San Francisco, the states where Maloney was arrested.
Federal agents began tracking Maloney's online activity through the Internet, after he sold over 2,000 pills, prosecutors said.
Maloney, who works at a drugstore in a San Francisco suburb, was arrested Wednesday morning on suspicion of being selling unlicensed Viagra and other erectile dysfunction drugs in a drugstore.
The operation began as a "black package" with two men working for Maloney's online company, which sells Viagra, and another one selling a generic version of the erectile dysfunction drug, Pfizer Inc.'s Viagra.
One of the two men said he bought the pills from a friend who was selling them to him and had been using the drugs for several months.
"I was in a lot of trouble," he said. "I was getting a lot of Viagra. I was getting a lot of counterfeit pills. I had to get them from friends. I had to put a little bit of effort in. I was getting a lot of fake Viagra."
The other man said he and the man went to his local pharmacy where they bought the pills for Maloney. The man said he had been taking the pills for two months when Maloney bought them.
When he returned to the pharmacy, the man said he had bought several pills. Maloney said he began to see a doctor.
"I started to take the pills again. I started to feel dizzy," he said. "There was this feeling of being drunk. I started to feel like I was in a lot of pain."
Maloney said he took the pills on a regular basis for about two months. He said he started to feel better after the first few months and that he felt better after three months.
The man said the pills were "good" and he thought he was getting "good" pills. Maloney said he bought the pills with the help of a friend. The man said he didn't see the drug on the label as it was not being sold on the Internet.
Maloney said he did not give the man a receipt because he believed he would not sell the drugs on the Internet.
The man was arrested last Wednesday after he was arrested on federal charges. He is being held at the U. Postal Inspection Service at than at the federal facility.
